Any personally identifiable information you elect to make publicly available on our Services, such as our social media pages, will be available to others. If you remove information that you have made public, copies may remain viewable in cached or archived pages, or if other users have copied or archived that information. We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

 

Disclosure of Nonpublic Information

Our policy is never to disclose nonpublic information about you. Nonpublic personal information is defined as any information that we acquire by using information you have provided us in connection with any Services we perform, which is not public information. Information acquired is disclosed only under the following conditions:

 

I.  Uses and Disclosures for Treatment, Payment, and Health Care Operations

We may use or disclose your protected health information (PHI), for treatment, payment, and health care operations purposes with your consent. To help clarify these terms, here are some definitions:

  • Use” applies only to activities within our practice group such as sharing, employing, applying, utilizing, examining, and analyzing information that identifies you.
  • Disclosure” applies to activities outside of our practice group, such as releasing, transferring, or providing access to information about you to other parties.
  • “Treatment” is when we provide, coordinate, or manage your care and other services related to your care. An example of treatment would be when we consult with another health care provider, such as your family physician or another psychologist.
  • “Payment” is when we obtain reimbursement for your Examples of payment are when we disclose your PHI to your health insurer to obtain reimbursement for your health care or to determine eligibility or coverage.
  • “Health Care Operations” are activities that relate to the performance and operation of our Examples of health care operations are quality assessment and improvement activities, business- related matters such as audits and administrative services, and case management and care coordination.

 

We may also use or disclose your PHI to:

  • Obtain approval for services in advance from your insurance
  • Exchange information with Social Security, Employment Security, or Social Service.
  • Measure and evaluate the quality of our services as requested by your insurer.

 

II.  Uses and Disclosures Requiring Authorization

We may use or disclose PHI for purposes outside of treatment, evaluation, payment, and health care operations when your appropriate authorization is obtained. An “authorization” is a written permission above and beyond the general consent that permits only specific disclosures. In those instances when we ask for information for purposes outside of treatment, payment, and healthcare operations, we will obtain an authorization from you before releasing this information.

You may revoke all such authorizations at any time, provided each revocation is in writing. You may not revoke an authorization to the extent that (1) We have relied on that authorization; or (2) if the authorization was obtained as a condition of obtaining insurance coverage, and the law provides the insurer the right to contest the claim under the policy.

Psychotherapy notes that are kept separate from the record enjoy special protection and require authorization for release, with certain exceptions.

 

III.  Uses and Disclosures with Neither Consent nor Authorization

We may use or disclose PHI without your consent or authorization in the following circumstances:

  • Child Abuse: If we know, or have reasonable cause to suspect, that a child is abused, abandoned, or neglected by a parent, legal custodian, caregiver, or other person responsible for the child’s welfare, the law requires that we report such knowledge or suspicion to the Florida Department of Child and Family Services.
  • Adult and Domestic Abuse: If we know, or have reasonable cause to suspect, that a vulnerable adult (disabled or elderly) has been or is being abused, neglected, or exploited, we are required by law to immediately report such knowledge or suspicion to the Central Abuse Hotline.
  • Health Oversight: If a complaint is filed against us with the Florida Department of Health on behalf of the Board of Psychology, the Department has the authority to subpoena confidential mental health information relevant to that complaint.
  • Judicial or Administrative Proceedings: If you are involved in a court proceeding and a request is made for information about your diagnosis or treatment and the records thereof, such information is privileged under state law, and we will not release information without the written authorization of you or your legal representative, or a subpoena of which you have been properly notified and you have failed to inform us that you are opposing the subpoena or a court The privilege does not apply when you are being evaluated for a third party or where the evaluation is court ordered. You will be informed in advance if this is the case.
  • Serious Threat to Health or Safety: When you present a clear and immediate probability of physical harm to yourself, toother individuals, or to society, we may communicate relevant information concerning this to the potential victim, appropriate family member, law enforcement, or other appropriate authorities.
  • Worker’s Compensation: If you file a worker’s compensation claim, we must, upon request of your employer, the insurance carrier, an authorized qualified rehabilitation provider, or the attorney for the employer or insurance carrier, furnish your relevant records to those persons.
  • Social Security Administration (SSA): If you are referred to us for a disability determination evaluation, all personal information SSA collects is protected by the Privacy Act of 1974. Once medical information is disclosed to SSA, it is no longer protected by the health information privacy provisions of 45 CFR, part 164, mandated by the Health Insurance Portability and Accountability Act (HIPAA).

 

Additional circumstances in which we can use or disclose your PHI without your authorization include:

  • To send appointment reminders and notifications when an appointment is cancelled or changed.
  • When required by law, including for investigations, audits, inspections, and licensure.
  • To comply with a validly issued and enforceable subpoena or summons.
  • In the course of a review of our company’s practices under the authorization of a state or national licensing or certification board, or as necessary to properly respond to an inquiry or complaint from such a licensing board or organization.
  • As a part of any actual or threatened legal proceedings or alternative dispute resolution proceedings either initiated by or against us, provided we disclose only the information necessary to file, pursue, or defend against the lawsuit and take reasonable precautions to ensure that the information disclosed does not become a matter of public record.
  • To provide information to affiliates of the company and nonaffiliated third parties who perform services or functions for us in conjunction with our Services to you, but only if we have a contractual agreement with the other party, which prohibits them from disclosing or using the information other than for the purposes for which it was disclosed.
  • To treat you in an emergency.
  • To inform you of possible treatment options or services.
  • For agencies involved in a disaster

 

Children’s Privacy

Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information from those we know to be under 13 years of age.

 

Third Party Services

The website contains references and links to websites and services provided by third parties. Any personally identifiable information you provide on third party sites or services is provided directly to that third party and is subject to that third party’s policies governing privacy and security. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links are displayed on the Service. We encourage you to learn about third parties’ privacy and security policies before providing them with personally identifiable information.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. From time to time, we may use your information for new, unanticipated uses not previously disclosed in our privacy policy.
